Washington DUI Penalties Explained by a Seattle DUI Attorney

Washington DUI penalties can be confusing and complex. The penalties oftentimes depend upon factors like how many times you have been previously arrested and your blood alcohol level. Here is a look at possible penalties you may face:

  • 1st Offense. If your blood alcohol level is below 0.15, you face a mandatory minimum 24-hour jail sentence and up to 364 days in jail. In addition, you could face a monetary fine up to $5,000 and a license suspension. If your blood alcohol level is at or above 0.15, your minimum jail time may be doubled to 48 hours.
  • 2nd Offense. If you have one prior DUI offense and your blood alcohol level is below 0.15, you face a mandatory minimum 30-day jail sentence. In addition, you may have to pay a $5,000 fine and may receive a license suspension up to two years. If your blood alcohol level is at or above 0.15, you face a mandatory minimum 45-day jail sentence.
  • 3rd or 4th Offense. If your blood alcohol level is below 0.15, you face a mandatory minimum 90-day jail sentence. You may also be ordered to pay a fine of up to $5,000 and receive a license suspension up to three years. If your blood alcohol level is at or above 0.15, you could face a mandatory minimum 120-day jail sentence.
  • 5th or More Offense. Individuals who have been arrested for the fifth or more offense could felony criminal charges. This can include a five-year prison sentence along with monetary fines and license suspensions.
